Welcome to AmarVasha. This is an online one-to-one tutoring service for children to learn Bangla language. Tinkers Technologies Limited (the “Company”) is committed to maintaining robust privacy protections for its users. Your privacy is very important to us. So we've developed this Privacy Policy (“Privacy Policy”) that covers how we collect, use, disclose, transfer, store and safeguard the information you provide to us and to assist you in making informed decisions when using our Service. For purposes of this Agreement, “Site” refers to the Company’s website, which can be accessed at amarvasha.tinkers.ltd , amarvasha.net or any of its subdomains. “Service” refers to the Company’s services accessed via the Site. The terms “we,” “us,” and “our” refer to the Company. “You” refers to you and/or your child, as a user of our Site or our Service. By accessing our Site or our Service, you accept our Privacy Policy and Terms of Use, and you consent to our collection, storage, use and disclosure of your Personal Information as described in this Privacy Policy. We hope you read it carefully and make the choices you think are appropriate in accordance with the guidance of this "Privacy Policy" when necessary. We try to use concise expressions of related technical terms involved in this "Privacy Policy" to facilitate your understanding. If you do not agree with the relevant content of this "Privacy Policy" about basic business functions, it may affect the effectiveness of providing you with corresponding products and/or services. 1.How do we collect and use your personal information

Personal Information is data that can be used to identify, contact or develop our services such as your name, address, email address, phone number, your children's personal information, favourite choices, hobbies etc.


1.1 Registration Information

When you apply for ‘Amar Vasha’ services on Tinkers as a user (e.g. student’s guardian or student), you will be required to provide certain personal information, which may include your full name, nickname (if available), gender, present living country, time zone, academic qualifications, personal choices, hobbies, etc.

If you are a teacher, we also collect and store any additional information that you provide to us in your profile, which may include: your educational degree, your previous working experience, your flexibility and communication experience, your time availability, your location and address, pictures, your phone number, your social media account etc. We will sign up an NDA (Non Disclosure Agreement) with all our teachers, employees, and volunteers to ensure maximum security of the customer's private data


1.2 Personal Information

In addition to the information provided on our form, we might ask you sequentially to provide us some necessary information about your child’s choices such as favourite movies, favourite superhero characters, favourite video games or cartoons, favourite story etc. We believe every child is unique. So we are constantly researching and developing our services and we create personalized study material for each of our students based on your provided information. This information helps our teachers and content creator team to make our services more responsive and engaging.


1.3 Class Recording

We will conduct our classes on Zoom through video conferences and we may record our sessions with your child, including mock or trial classes. Video calling platforms may track your location, IP addresses, MAC address - as it does for any video call. That is up to Zoom's privacy policy. We do not have any business deal with Zoom. The teacher is responsible to send you a meeting link from his/her personal Zoom account. Please refer to Zoom's privacy policy for more information on video calling platform. During our class, sometimes the teacher may show interest to know about the child's personal information just to make the class more interactive and responsive. The purpose of the recording is to analyze a child's mindset to make more user-friendly, understandable and relatable content. The recorded audios and videos will be kept strictly confidential and will only be used to develop, train and research and will be for our internal use only. We will not disclose the recorded audios and videos to the public or share the recorded videos with any third parties. We can use video clips from the class recordings for product demonstration, promotional video and marketing purposes also. But we shall inform you via email before we do this.


1.4 Personalized Marketing

a) With your prior consent, we will ask you to provide you or the student’s personal information, including occupation, education, age, and gender information, in order to improve the effectiveness of our products, services, and publicity. We may use this kind of personal information to create an overall report about the user group. Such personal information and overall report are in an anonymous form and will not contain content that can identify you or the student.

b) Based on the needs of marketing activities, we will obtain email information with your authorized consent, so that we can share related activities with you at any time.

2.How do we share your information

We share personal information with our team members who are performing services for the company, such as the content creator who makes the study material needs to know what the children love. Those vendors use your Personal Information only at our direction and in accordance with our Privacy Policy and NDA.

In general, the Personal Information we collect is used to improve our services and enhance your experience with Tinkers. We may use your Personal Information to contact you for information, questions and feedback.


2.1 Sharing with Registered Students and Parents

If you are a teacher, we share with registered users (e.g. students and their parents) certain information that is included in your profile, which may include your contact information, your full name, your location (city, state/province, country), your profile picture, your gender, your age, or other information. We may also include in your profile any reviews from your previous classes and experience.


2.2 Sharing with Content Creator, Curriculum and Feedback Team

The Curriculum and Feedback Team works to develop our curriculum to deliver the best way of teaching and track student’s progress. The Content Creator Team works relentlessly to create interesting and entertaining study materials for every child. They use your child’s data (e.g. favorite video games, characters etc) to make personalized special study materials for each child.


2.3 Sharing with Teachers

If you are a guardian of a student, in order to make our class more effective, we share with registered users certain information which may include your child’s behaviour pattern, favourite things, favourite books or video games, your location (city, state/province, country), your profile picture, your gender, your age, or other information. The more information you share, the more we can make relatable study materials. We may also share your class recordings with other teachers for research, development or feedback.

We do not sell, trade, rent or otherwise share for marketing purposes your Personal Information with third parties without your consent. Except as otherwise described in this Privacy Policy, Tinker’s will not disclose, share, sell or rent Personal Information collected on our company to any third-party.


3.How do we store your personal information

Your personal information will be stored in the shortest time necessary to achieve the necessary purpose of the business function. If such retention period is exceeded, the personal information will be deleted or anonymized. As we are very concerned about your data, we store all your data in a Google Drive, or some other trustable storage providers like google drive. We download these data after every 2-4 months and store them offline in a hard drive in our office. This is to protect your data from any kind of online attack on the data server. We take full responsibility of any kind of data leak from our side. However, we can not take responsibility if the data is compromised by the storage service provider we are using (like Google Drive or other storage providers.) This is protected by their Privacy Policy. Your private information is only accessible by some of the core team members of Tinkers. If a teacher records any class, S/he deletes it from his local storage after uploading this to our online storage system. Besides, every team member, including teachers, has signed an NDA ( Non Disclosure Agreement) to ensure proper security.


4.Your Rights

4.1 Your rights to your personal information

In accordance with relevant Bangladeshi laws, regulations, standards, and common practices in other countries and regions, we guarantee that we exercise the following rights over your personal information:


4.1.1 Access to your personal information

You have the right to access your personal information, except for exceptions provided by laws and regulations. If you want to exercise data access rights, you can view or modify account settings and information by logging into your account when the platform website is ready. Till then, you can have full access over your data by asking us via email. However, we can not identify or share any data with you once it has been anonymized or deleted by our system or admin.


4.1.2 Correct your personal information

When you find that the personal information we process about you is wrong, you have the right to ask us to make corrections. You can apply for correction by the methods listed in "Accessing Your Personal Information". We will respond to your request for correction within 15 working days.


4.1.3 Delete your personal information

In the following situations, you can submit a request to us to delete personal information:

4 .1.4 Change the scope of your authorized consent

Each basic business function requires some basic personal information to be completed. For the collection and use of personal information collected for the purpose of expanding business functions, you can give or withdraw your authorization consent at any time, and you can manage your authorization through website's account settings when the website is published. Till then we have to do this manually via email communication. When you withdraw your consent, we will no longer process the corresponding personal information. However, your decision to withdraw your consent will not affect the previous processing of personal information previously carried out based on your authorization.


4 .1.5 The personal information subject cancels the account

email. After you provide the relevant information, we verify that it will not affect your exercise of other rights on the website. Go through the corresponding procedures for you. After canceling the account, we will stop providing you with products or services, and anonymize or delete your personal information according to your requirements, unless otherwise stipulated by laws and regulations.

To ensure safety, you may need to provide a written request or prove your identity in other ways. We may ask you to verify your identity before processing your request. We will reply within fifteen working days. If you are not satisfied, you can complain through the customer service email also. We also have the right to refuse the request if we think it is not rightful.


4.2 Unable to respond to your request

In the following situations, we will not be able to respond to your request:

4.2.1 Related to the personal information controller's performance of its obligations under laws and regulations;

4.2.2 Directly related to national security and national defense security;

4.2.3 Directly related to public safety, public health, and major public interests;

4.2.4 Directly related to criminal investigation, prosecution, trial and execution of judgments;

4.2.5 The personal information controller has sufficient evidence that the subject of personal information is subjectively malicious or abuses his rights;

4.2.6 In order to protect the important legal rights and interests of the personal information subject or other individuals' lives and property, but it is difficult to obtain consent;

4.2.7 Responding to the request of the personal information subject will result in serious damage to the legal rights of the personal information subject or other individuals and organizations;

4.2.8 Involving trade secrets.


5. Security

We only retain your personal information for the purposes described in this Privacy Policy and within the time limit allowed by laws and regulations. In order to ensure the security of your information, Tinkers will take reasonable and necessary measures to protect your information under the existing technical level, and adopt physical, technical and administrative security measures to reduce loss, misuse, unauthorized access, disclosure and changes risks, including but not limited to transport layer data encryption, firewalls and encrypted storage, physical access control, and information access authorization control.

We are dedicated to protecting your Personal Information and take reasonable security measures to ensure that your information is treated securely and in accordance with this Privacy Policy. Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us. We do not accept liability for unintentional access, use or disclosure of your information. We also can not ensure that our system is 100% foolproof or hack-proof and we can not take responsibility if our system is compromised by any such attack or system failure. But we assure you that we shall take preventative measures from our side.


6.Protection of Children’s personal information

We understand that the personal information of students we collect and process may come from minors under the age of 13 ("children") and we take the protection of children's personal information very seriously. In this regard, we strictly implement the Bangladeshi Child Laws and protection responsibilities and make the following commitments :

i) Before collecting personal information of children, we will remind children and their guardians to read this "Privacy Policy" and inform them of the scenes in which we collect and process children's personal information and the information security protection measures we have taken;

ii) We will only collect and process children's personal information under the premise of obtaining the authorized consent of the child guardian, and process this part of personal information in strict accordance with the law with the guardian's consent or when necessary to protect the child;

iii) Under normal circumstances, we will not collect personal information that is not related to the realization of the corresponding functional scenarios described in this privacy policy; if it is indeed necessary to collect and process beyond the agreed purpose and scope due to business needs, we will specifically inform the child's guardian and collect with their consent;

iv) We will strictly set information access rights under different functions and control the scope of children's personal information

v) In order to better protect the information protection of minors, we will designate a person or team to be responsible for the protection of children's personal information. If you have any questions, you can send an email to the contact information attached.

vi) We ask the guardians and parents to let the child use our service under adult supervision of any of the family members and never leave the child alone online class or in our website.

vii) This service is intended to be used under parent supervision and guidance. No child should be able to avail this service by their own or without the consent from his/her guardian.


7.How your personal information is transferred globally

In principle, the personal information we collect and generate in our class will be stored on Google Drive (or some other prominent storage service) and we also store the data in physical hard drives in our office and will only be transferred overseas on the basis of your authorized consent. At present, when students receive course services via Zoom or any video calling platform, our teachers will be exposed to the personal information provided by the students to ensure classroom interaction and course quality. The above classroom video and personal information in it may include your name, country or regional address, timezone, nickname, hobbies, personal choices and other personal information you actively provide in the classroom. In the above scenarios, your personal information may be accessed or obtained by the above mentioned institutions or individuals. We only transmit the minimum range of personal information as necessary to achieve the above purposes, and will strictly abide by the requirements of relevant laws and regulations of Government Of Bangladesh to protect your personal information and ensure the security, confidentiality and integrity of related personal information in cross-border transmission.


8.Scope of Privacy policy

This policy applies to all our users, teachers, team members, volunteers, vendors and partners.

This Privacy Policy is only applicable for AmarVasha platform of Tinkers Technologies Ltd. Please note that this "Privacy Policy" only applies to the information we collect, store, use, share, and disclose. Please be informed that if you provide your personal information to a third party while browsing a third-party website or using third-party products and/or services, your information should be subject to the third-party’s privacy statement or similar policy. We are not responsible for any data collected by third party media (e.g. Zoom, Google Drive, Web Hosting Providers, Storage Services, Google Forms, Google Slides etc).


9.Changes to privacy Policy

The Company reserves the right to change this policy and our Terms of Service at any time. We will notify you of significant changes to our Privacy Policy by sending a notice to the primary email address specified in your account or by placing a prominent notice on our site. Significant changes will go into effect 15 days following such notification. Non-material changes or clarifications will take effect immediately. You should periodically check the Site and this privacy page for updates.


10.Merge and Acquisition

If we sell or otherwise transfer part or the whole of Tinkers Technologies Ltd business and/or our assets to another organization in a merger, acquisition, or other corporate restructuring transaction, or we are involved in a bankruptcy, dissolution or liquidation, your information such as name and email address and any other information collected through our Site or Service may be among the items sold or transferred. You will be notified of any such change in corporate ownership or use of your Personal Information, and your choices regarding the information. However, the data we collected under this privacy policy will always remain under it. New data can be subject to new policy if the ownership of the service is changed.
